Voter List Revision in Bihar undermines Constitutional Rights and Electoral Fairness

New Delhi, 3 July 2025:Maulana Mahmood Madani, President of Jamiat Ulama-i-Hind, has raised serious concerns over the ongoing special revision of the voter list in Bihar, calling it a threat to constitutional rights and electoral fairness. He warned that this hasty and unclear process—based on arbitrary and one-sided instructions—could disenfranchise millions of citizens, particularly migrant workers, minorities, and marginalized communities, by depriving them of their fundamental right to vote.

Maulana Madani questioned the practicality of verifying the identities of over eight crore voters within a single month. He also objected to the requirement that individuals born after July 1, 1987, must submit documents from at least one parent, and those born after 2004 must provide documents from both parents. “If this is not an NRC (National Register of Citizens), then why are NRC-style procedures being enforced?” he asked. He warned that, as seen in Assam, thousands of women—especially those lacking formal education or proper documentation—would be disproportionately affected, as they often do not possess proof of parental linkage.

He reiterated that the right to vote is a fundamental democratic entitlement under Article 326 of the Indian Constitution. Any attempt to curtail this right violates the spirit of the Constitution and strikes at the heart of India’s democratic and social fabric.

Given the grave implications, Jamiat Ulama-i-Hind urges the Election Commission of India to immediately withdraw the directive issued under the Special Intensive Revision (SIR) process. The Commission must adopt a reasonable and inclusive timeline, and ensure that voter registration follows standard procedures—without resorting to excessive documentation demands. Furthermore, migrant workers should not be excluded from the rolls; instead, proactive measures must be taken to protect and facilitate their voting rights.

Maulana Madani strongly stated, “If the right to vote is denied, it is not just electoral injustice—it is the erasure of identity, rights, and the future of citizens.” He cautioned that if state institutions act with bias or discrimination, the trust of minorities, migrants, and the poor in the electoral system—and the democratic framework as a whole—will be deeply shaken.

He concluded by reaffirming the unwavering commitment of Jamiat Ulama-i-Hind to defend the voting rights of every citizen—regardless of class, gender, or community. “We are determined to safeguard the democratic rights of all Indians through constitutional, legal, and peaceful means, and will firmly resist any attempt to suppress them,” he asserted.

नई दिल्ली, 3 जुलाई 2025:जमीयत उलमा-ए-हिंद के अध्यक्ष मौलाना महमूद असअद मदनी ने बिहार में जारी मतदाता सूची के विशेष पुनरीक्षण (Special Intensive Revision – SIR) को लेकर गहरी चिंता व्यक्त करते हुए कहा कि यह प्रक्रिया संविधानिक अधिकारों और लोकतांत्रिक न्याय के मूल सिद्धांतों पर सीधा हमला है। उन्होंने चेतावनी दी कि यह प्रक्रिया जल्दबाज़ी, असमंजस और एकतरफा निर्देशों पर आधारित है, जिससे करोड़ों नागरिक—खासतौर पर प्रवासी मजदूरों, अल्पसंख्यकों और वंचित तबकों—का उनके मौलिक मताधिकार से वंचित हो जाना संभव है।

मौलाना मदनी ने सवाल उठाया कि आठ करोड़ से अधिक मतदाताओं की पुष्टि महज़ एक महीने में कैसे संभव है? उन्होंने यह भी आपत्ति जताई कि 1 जुलाई 1987 के बाद जन्म लेने वालों से एक अभिभावक के दस्तावेज़ और 2004 के बाद जन्म लेने वालों से दोनों माता-पिता के दस्तावेज़ मांगे जा रहे हैं। "जब यह एनआरसी नहीं है तो फिर एनआरसी जैसी प्रक्रियाएं क्यों लागू की जा रही हैं?" उन्होंने पूछा। उन्होंने चेतावनी दी कि असम की एनआरसी की तरह, हजारों महिलाएं—जो औपचारिक शिक्षा और दस्तावेजों से वंचित हैं—सबसे अधिक प्रभावित होंगी, क्योंकि उनके पास अपने माता-पिता से जुड़ा कोई वैध प्रमाण नहीं है।

मौलाना मदनी ने जोर देते हुए कहा कि भारत के संविधान के अनुच्छेद 326 के तहत मताधिकार एक मूलभूत लोकतांत्रिक अधिकार है। इस अधिकार को किसी भी रूप में छीनने का प्रयास न सिर्फ संविधान की आत्मा के विरुद्ध है, बल्कि यह लोकतांत्रिक मूल्यों पर भी गहरा आघात होगा।

इन परिस्थितियों को देखते हुए, जमीयत उलमा-ए-हिंद निर्वाचन आयोग से मांग करती है कि इस विशेष पुनरीक्षण से संबंधित निर्णय को अविलंब वापस लिया जाए और एक व्यावहारिक व यथोचित समयसीमा तय की जाए। साथ ही, मतदाता पंजीकरण की प्रक्रिया को सामान्य व पारंपरिक तरीकों से चलाया जाए, न कि एनआरसी जैसी पद्धतियों से। विशेष रूप से प्रवासी मजदूरों को मतदाता सूची से हटाने के बजाय उनके मताधिकार की रक्षा की जाए।

मौलाना मदनी ने तीखे शब्दों में कहा, “यदि मताधिकार छीन लिया गया, तो यह केवल चुनावी अन्याय नहीं होगा, बल्कि नागरिकों से उनकी पहचान, उनका हक और उनका भविष्य छीन लेने जैसा होगा।” उन्होंने आगाह किया कि यदि राज्य संस्थाएं पक्षपातपूर्ण और भेदभावपूर्ण रवैया अपनाएंगी, तो देश के अल्पसंख्यकों, प्रवासियों और गरीब तबकों का विश्वास न केवल निर्वाचन प्रणाली, बल्कि पूरे लोकतांत्रिक ढांचे से उठ जाएगा। मौलाना मदनी ने यह दृढ़ संकल्प दोहराया कि जमीयत उलमा-ए-हिंद देश के हर नागरिक, हर मज़दूर, हर महिला और हर अल्पसंख्यक के मताधिकार की रक्षा के लिए पूरी संवैधानिक, कानूनी और लोकतांत्रिक ताक़त के साथ संघर्ष करेगा। “यदि कोई इन अधिकारों को छीनने का प्रयास करेगा, तो हम उसका हर स्तर पर डटकर मुकाबला करेंगे।
