Legal Help for the riot Victims
The serious allegations of biasness of the police against minorities during periods of communal violence are not a new phenomenon. There are certain situations when this biasness was so obvious that it surpassed all the limits of discipline which an enforcing agency is required to maintain. The government has never taken serious steps to remedy the situation.
The same case was repeated in the wake of the Delhi riots. Delhi police failed to protect lives and properties of the minority communities. Muslim homes, shops and vehicles were selectively targeted during the rioting that erupted in northeast Delhi in February when protests against the new Citizenship Amendment Act (CAA) broke out across the country. It is painful to submit that the role of police in a democratic society, particularly in Delhi, is biased, having communal colour and discriminatory while the role of the police should be different from that of police in Colonial society. The role of police officer “as a Law Enforcement Officer is to serve mankind; to safeguard lives and property; to protect the innocent and weak against violence and disorder; to keep the peace; and to ensure the constitutional rights of all to liberty, equality and justice irrespective of caste and creed.”But unfortunately, the police have shown inhuman behavior against the minority community, mostly the victims of riots. Instead of arresting the culprits and rioters, the police arbitrarily arrested Muslims youths.
In this critical condition when the culprits were left scot free and innocent are being put behind bar, the Jamiat legal team came forward t to provide proper legal help to the riot victims to get the FIR lodged on correct facts against the culprits/ rioters, for fair investigation by SIT headed by retired Judge of Delhi High Court or Supreme Court and for protecting and releasing the innocent from the clutch of police atrocities.
The Jamiat deputed battery of lawyers in the riots hit areas to get the F.I.R lodged on right facts against the culprits and to get compensation for the loss of live and properties. For this, legal camp office was set up in Madina Masjid Indra Vihar, Mustabad, Madarsa Baitul Uloom and Madarsa Babul Uloom Jafrabad. Adv. Mohammad Nurullah was assigned to look in to his matter. Apart from this, Jamiat filed PIL in the Delhi High Court for fair investigation.
The following is a brief report of the legal recourse taken by the Jamiat for the communal riots victims:
- Habeas corpus Petitions for missing persons: Mohammad
Huzefa and Mohammed Mursaleen were filed in the Delhi High Court. As a result Mohammad Huzefa was traced within 24 hours and Mohammad Mursaleen’s body was fished out and handed over by the police.
- Jamiat Ulama-i-Hind filed PIL in Delhi High Court
For setting up of Special Investigation Team and preserving CCTV footage of the riot-affected areas from February 23 to March 1 and not removing debris without collecting evidence from the site. It also sought FIRs against those involved in the violence and the guilty police officials.
