Jamiat condemns UP Chief Minister's Statement on Gyanvapi Masjid, deems it Attempt to Influence Impartial Judicial Process

Jamiat Ulama-i-Hind’s president Maulana Mahmood Asa’d Madani has taken exception to the recent statement made by the Chief Minister of Uttar Pradesh regarding the Gayanvapi Masjid despite the matte being sub-judice. “Such unwarranted remarks have the potential to compromise the ongoing legal proceedings and undermine the principles of a fair and impartial judicial process.”
“The Gayanvapi Masjid issue is presently before the courts, and it is of utmost importance that all concerned parties, including public officials, demonstrate respect for the sanctity of these legal proceedings and refrain from making statements that could influence the case's outcome. The principle of sub-judice is fundamental in ensuring that justice is delivered without any external interference or pressure, and any disregard for this principle threatens the integrity of our judicial system.”
“By making public remarks on a sub-judice matter, the Chief Minister not only compromised the spirit of a fair trial but also risks inciting unrest and tension among communities. It is crucial for public officials to exercise caution and restraint when commenting on sensitive legal matters, especially those closely related to communal harmony and social cohesion.”
Jamiat Ulama-i-Hind urges the Chief Minister of Uttar Pradesh to uphold the principle of sub-judice and demonstrate respect for the rule of law. As elected representatives, it is essential to act responsibly and prioritize the well-being of the state's citizens over any political or personal interests.
Maulana Madani reiterated that Jamiat Ulama-i-Hind has consistently maintained its stand that no public protest and no judicial intervention by other parties, except the Masjid intezamia committee, are required—a stance that most Muslim organizations still adhere to. The recent statement by the Chief Minister has once again sparked unnecessary debates and discussions in the country, which are not in the best interest of the nation. Thus, it is of utmost importance to respect the judicial process and refrain from engaging in politics driven by sentimentality.

ज्ञानवापी मस्जिद पर उ.प्र. के मुख्यमंत्री का बयान निष्पक्ष न्यायिक प्रक्रिया को प्रभावित करने का प्रयासः मौलाना महमूद मदनी

नई दिल्ली, 01 अगस्त 2023। जमीअत उलमा-ए-हिंद के अध्यक्ष मौलाना महमूद असद मदनी ने उत्तर प्रदेश के मुख्यमंत्री योगी आदित्यनाथ द्वारा ज्ञानवापी मस्जिद पर दिए गए हालिया बयान को अनुचित और न्यायिक प्रक्रिया को प्रभावित करने का प्रयास बताया। मौलाना मदनी ने कहा कि ज्ञानवापी मस्जिद का मामला फिलहाल अदालतों के समक्ष विचाराधीन है। ऐसे में मुख्यमंत्री जैसे महत्वपूर्ण पद पर बैठे व्यक्ति के लिए जरूरी है कि न केवल न्यायिक प्रक्रिया का सम्मान करें बल्कि दूसरों को भी इसका सम्मान करने के लिए प्रेरित करें।
मौलाना मदनी ने कहा कि न्याय के सिद्धांत के लिए यह अति आवश्यक है कि वह किसी भी बाहरी हस्तक्षेप या दबाव और किसी भी पक्षपात से मुक्त हो। इस सिद्धांत से मुंह फेरना हमारी न्यायिक प्रणाली की अखंडता और पारदर्शिता के लिए खतरा है। हमारा मानना है कि एक मजबूत और स्वतंत्र न्यायपालिका लोकतांत्रिक समाज की नींव है और कानून का शासन हर हाल में स्थापित रहना चाहिए। कानूनी प्रक्रिया में हस्तक्षेप करने या निचले न्यायिक मामलों को प्रभावित करने का कोई भी प्रयास अनुचित और गुमराह करने वाला है।
मौलाना मदनी ने कहा कि इस विचाराधीन मामले पर सार्वजनिक टिप्पणी करके मुख्यमंत्री ने न केवल निष्पक्ष सुनवाई को प्रभावित करने की व्यर्थ कोशिश की है, बल्कि इससे दो संप्रदायों के बीच अशांति और तनाव बढ़ने और न्याय में जनता का विश्वास खोने का भी खतरा है। इसलिए संवेदनशील कानूनी मामलों पर टिप्पणी करते समय सावधानी और संयम बरतना बहुत जरूरी है। जनप्रतिनिधि पर न्यायिक प्रणाली में विश्वास और भरोसे के माहौल को बढ़ावा देने की जिम्मेदारी लागू होती है। इसलिए हम उत्तर प्रदेश के मुख्यमंत्री से अनुरोध करते हैं कि वह कानून के शासन के प्रति जिम्मेदारी दिखाएं और किसी भी राजनीतिक स्वार्थ पर राष्ट्र और उसके नागरिकों के कल्याण को प्राथमिकता दें।
मौलाना मदनी ने कहा कि जमीअत उलमा-ए-हिंद ने आरंभ में ही सार्वजनिक विरोध और मस्जिद की इंतेजामिया कमेटी के अलावा दूसरे संगठनों और दलों से न्यायिक हस्तक्षेप न करने की अपील की थी, जिस पर मुस्लिम संगठनों की अधिकांश संस्थाएं अभी भी पालन कर रही हैं। मुख्यमंत्री के इस बयान के बाद एक बार फिर देश में अनावश्यक बहस और चर्चाओं का सिलसिला शुरू हो गया है, जो बिल्कुल भी देश हित में नहीं है। इससे देश में जो अराजकता का वातावरण पैदा होता है, उसका परिणाम पूरा देश पूर्व में और वर्तमान में भी, लगातार भुगत रहा है। इसलिए न्यायिक प्रक्रिया का सम्मान और भावनात्मक राजनीति से बचना बहुत जरूरी है।
